Please read these terms carefully before using the SecureMyTenancy Agent Portal.

These Agent Terms and Conditions ("Terms") form a legally binding agreement between you (the "Agent") and Fresh Approach Projects Ltd t/a SecureMyTenancy ("SecureMyTenancy", "we", "us", "our"). By accessing or using the Agent Portal you agree to be bound by these Terms.
Agent Portal means the secure online platform provided by SecureMyTenancy for authorised letting agents to submit and manage applications on behalf of tenants.
Application means a request submitted via the Agent Portal for a tenant to receive a SecureMyTenancy product.
Product means any of SecureDeposit, SecureRent, or SecureComplete as offered by SecureMyTenancy from time to time.
Revenue Share means the financial payment made by SecureMyTenancy to the Agent in respect of activated Applications, at the rate agreed at onboarding.
Tenant means the individual or individuals named as applicant(s) on an Application.
2.1 Access to the Agent Portal is granted by SecureMyTenancy at its sole discretion following successful onboarding and agreement to these Terms.
2.2 The Agent is responsible for ensuring that all individuals within the agency who access the Agent Portal are aware of and comply with these Terms.
2.3 The Agent must not share login credentials with any third party outside the agency. Each user must have their own account.
2.4 SecureMyTenancy reserves the right to suspend or terminate access at any time if it believes these Terms have been breached.
3.1 The Agent warrants that all information submitted via the Agent Portal is accurate, complete, and provided with the knowledge and consent of the Tenant.
3.2 The Agent must obtain the Tenant's express consent before submitting an Application on their behalf, including consent to credit and reference checks being carried out.
3.3 The Agent must not submit Applications on behalf of Tenants who have not been properly informed of the nature, terms, and cost of the SecureMyTenancy Products being applied for.
3.4 SecureMyTenancy is not responsible for any errors, omissions, or inaccuracies in Applications submitted by the Agent.
3.5 SecureMyTenancy reserves the right to decline any Application at its sole discretion and is not required to provide reasons for a decline decision.
Agents must present all available options to tenants. SecureMyTenancy must not be presented as the only option available to a tenant.
3A.1 Before recommending or facilitating a SecureMyTenancy product, the Agent must inform the Tenant that they are not required to use SecureMyTenancy and that alternative options exist, including:
3A.2 The Agent must not apply pressure on a Tenant to use SecureMyTenancy or make the tenancy conditional upon the use of SecureMyTenancy products.
3A.3 The Agent must confirm in writing to SecureMyTenancy, upon request, that these obligations have been met for any Application submitted.
3A.4 Failure to comply with this clause may result in immediate suspension of Agent Portal access and forfeiture of any outstanding Revenue Share.
4.1 Revenue Share is payable to the Agent in respect of Applications that result in an activated Product, subject to the rate and payment terms agreed with the Agent at onboarding.
4.2 Revenue Share is calculated on the net product fee paid by the Tenant and is paid monthly in arrears, by bank transfer to the account nominated by the Agent.
4.3 Revenue Share is not payable where an Application is declined, withdrawn, or results in a refund to the Tenant.
4.4 SecureMyTenancy reserves the right to adjust Revenue Share rates on 30 days' written notice. Revised rates will apply to Applications submitted after the effective date of the change.
4.5 In the event of a dispute regarding a Revenue Share payment, the Agent must notify SecureMyTenancy in writing within 30 days of the relevant payment date.
5.1 The Agent must comply with all applicable laws and regulations, including but not limited to the Consumer Duty rules, the Financial Services and Markets Act 2000, the Data Protection Act 2018, and UK GDPR.
5.2 The Agent must not make any representations about SecureMyTenancy Products that are inaccurate, misleading, or inconsistent with SecureMyTenancy's published materials.
5.3 The Agent must not describe SecureMyTenancy Products as insurance products or suggest that they are regulated by the Financial Conduct Authority.
5.4 The Agent must inform Tenants that the £16.99 referencing fee is non-refundable before submitting an Application.
5.5 The Agent must promptly notify SecureMyTenancy of any complaint received from a Tenant in connection with a SecureMyTenancy Product.
6.1 Each party is an independent data controller in respect of personal data processed in connection with these Terms.
6.2 The Agent must ensure that it has a valid lawful basis for sharing Tenant personal data with SecureMyTenancy, including obtaining appropriate consent where required.
6.3 SecureMyTenancy will process Tenant personal data in accordance with its Privacy Policy, available at securemytenancy.co.uk/privacy.
7.1 The Agent agrees to keep confidential all non-public information received from SecureMyTenancy, including Revenue Share rates, product pricing structures, and underwriting criteria.
7.2 This obligation survives termination of the Agent's access to the Agent Portal.
8.1 SecureMyTenancy's liability to the Agent under or in connection with these Terms is limited to the total Revenue Share paid to the Agent in the three months preceding the event giving rise to the claim.
8.2 SecureMyTenancy is not liable for any indirect, consequential, special, or punitive loss or damage arising in connection with these Terms.
8.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
9.1 Either party may terminate the Agent's access to the Agent Portal on 30 days' written notice.
9.2 SecureMyTenancy may terminate access immediately where it reasonably believes the Agent has breached these Terms, engaged in fraudulent activity, or acted in a manner that may bring SecureMyTenancy into disrepute.
9.3 On termination, any Revenue Share accrued and unpaid in respect of activated Applications before the termination date will remain payable.
10.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
10.2 Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
